1. Outbound email — CAN-SPAM is the floor
You will only send commercial email through ASINBuyer that complies with the U.S. CAN-SPAM Act (15 U.S.C. §7701 et seq.) and any applicable state commercial-email statutes (e.g. California Business and Professions Code §17529.5). That means:
- Truthful, non-misleading subject lines and headers.
- Clear identification of the message as a commercial outreach.
- A working, one-click unsubscribe link — already added to every outbound by the platform.
- Your real business name and physical postal address in the footer — collected at onboarding and embedded automatically.
- Honoring opt-outs within 10 business days of receipt. The platform writes them to the workspace suppression list instantly; you must not bypass it.
2. Who you may contact
- Business contacts only. ASINBuyer is a B2B platform. You must not upload, import, or target consumer (B2C) contact lists.
- No purchased / leaked databases. You may import contacts you collected from public sources or your own CRM, but not lists bought from data brokers, sourced from leaked breaches, or scraped from platforms whose terms of service forbid scraping.
- No prior opt-outs. Anyone who unsubscribed from your previous campaigns — on or off ASINBuyer — stays off your outbound. The workspace suppression list handles this automatically; you must not re-add the same address through a new import.
- No protected groups. You will not target outreach based on race, religion, disability, sexual orientation, or other protected characteristics.
3. Content rules
- No deceptive or fraudulent claims, fake testimonials, or fabricated case studies.
- No phishing, malware, or credential-harvesting attempts of any kind.
- No content that infringes third-party intellectual property.
- No harassment, threats, hate speech, or content that targets an individual personally.
- No promotion of regulated goods or services where prohibited (firearms, illegal drugs, gambling jurisdictions that forbid it, etc.).
4. Platform abuse
- No attempts to bypass credit deduction, suppression-list enforcement, or rate limits.
- No scraping, reverse-engineering, or automated mass extraction of platform data outside the documented APIs.
- No attempts to impersonate the ASINBuyer brand to a prospect — the recipient must always understand they are receiving outreach from your business, not from us.
- No load testing or denial-of-service traffic against the platform without prior written permission.
5. Domain reputation responsibility
Outbound email is sent from ASINBuyer-managed infrastructure. A customer that repeatedly triggers spam complaints, bounces, or blacklist hits damages the shared sending reputation that every other customer depends on. We may rate-limit, pause, or terminate a workspace that crosses thresholds — typically a spam complaint rate above 0.1%, or a hard-bounce rate above 2% on a 7-day rolling window.
6. AI voice calls — TCPA + DNC
AI voice outreach through Aria is governed by the Telephone Consumer Protection Act (47 U.S.C. §227), FCC regulations (47 C.F.R. §64.1200), and applicable state DNC / telemarketing statutes. You agree:
- Aria's opening line must identify the call as an AI calling on behalf of your business — never claim a human is on the line. This satisfies the FCC's 2024 ruling on AI-generated voices in telephone communications.
- Respect every recipient's right to terminate the call. A "remove me from your list" verbal request must be honored the same way as an email unsubscribe — the platform writes it to the suppression list automatically.
- Honor the National Do-Not-Call Registry. Calling U.S. numbers on the National DNC list without a prior business relationship is prohibited. State DNC lists (e.g. Texas, Florida, Indiana) apply on top.
- No calls outside reasonable business hours in the recipient's local time zone — TCPA caps this at 8:00 a.m. to 9:00 p.m. local recipient time (47 C.F.R. §64.1200(c)(1)).
- Keep written records of express consent for any number you contact under a prior-business-relationship or written-consent exception. ASINBuyer retains call metadata; substantive consent records (signed agreements, prior invoices, etc.) are your responsibility.
7. Reporting abuse
If you receive an email or call that violates this policy and appears to originate from an ASINBuyer customer, please forward it to support@asinbuyer.com with full headers / call metadata. We investigate every report and act within 5 business days.
8. Enforcement
A violation is a material breach of the Terms of Service. Depending on severity we may issue a warning, rate-limit your workspace, force-suppress affected lists, suspend outbound, or terminate your account without refund. Repeated or wilful abuse is reported to the relevant authority.
